    Le Mandat de gestion de fortune - The asset management mandate
    Samantha Meregalli Do Duc, who specializes in banking and finance law, just published the book “Le Mandat de gestion de fortune” (The asset management mandate) with Schulthess as a co-editor. She also contributed to the book with two articles on “L’obligation de rendre compte” and “L’obligation de restituer”.
     
    The book examines the legal and regulatory framework under Swiss law (continuously redefined by legal scholars and the courts) governing asset management activities, a topical and constantly evolving field, which plays an important role for Swiss financial institutions.
     
    The book analyzes assets management in its entirety and looks at the bank’s asset managers as well as managers of collective investment schemes, pension funds and independent assets managers by providing a detailed and up-to-date analysis.

    The Firm supports a specialised forum in real estate crowdfunding to take place Thursday, 7 December from 1.30pm to 7pm at the Fondation Louis Jeantet. This forum is jointly organised by the Swiss Crowdfunding Association and the Swiss Fintech Convention.
     
    Pierre Turrettini will participate at this forum as a speaker, in particular regarding the regulatory aspects of this type of activity.

    Borel & Barbey advised Kernel Holding S.A. as Swiss Counsel (jointly with Freshfields Bruckhaus Deringer, as lead counsel) on the issuance of its USD 500m guaranteed notes due in 2022, carrying an interest rate of 8.75%. 
     
    Kernel is a diversified Ukrainian-based agribusiness company listed on the Warsaw Stock Exchange. It is a leading exporter of, among other products, sunflower oil and grains. 
     
    This transaction is the first corporate bond issuance by an Ukrainian group since 2013, potentially re-opening the international bond market for Ukrainian issuers.
